1. Agreement

These Terms of Service govern your use of PortCode's website reconstruction and related services. By using PortCode, submitting a request, or completing a payment, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. The service

PortCode provides a manually reviewed reconstruction service. You may submit a public website reference and receive an implementation starting point or other deliverable described at checkout. Delivery timing is an estimate, not a guarantee. We may contact you using the details supplied through checkout.

PortCode is not an agency of, partner of, or representative of the owner of a submitted website unless expressly agreed in writing.

3. Your authorization and responsibilities

You must have the legal right and necessary permission to access, study, submit, and request work based on every URL, asset, design, text, logo, brand, and other material you provide. You must not submit private, access-controlled, stolen, confidential, or unlawfully obtained material.

You are responsible for reviewing the result before using, publishing, or distributing it. You are also responsible for complying with copyright, trademark, privacy, publicity, consumer-protection, computer-access, export-control, and other applicable laws, as well as the terms of third-party websites and services.

4. Prohibited use

You may not use PortCode to facilitate fraud, impersonation, phishing, malware, harassment, unlawful surveillance, unauthorized access, infringement, privacy violations, or other unlawful activity. We may refuse, cancel, suspend, or limit a request that we reasonably believe violates these Terms or creates legal, security, or operational risk.

5. Payment, cancellation, and refunds

Payments are processed by Polar. Polar may apply its own checkout terms, privacy notices, taxes, payment rules, and fraud checks. The price and scope shown at checkout control the transaction.

Refund eligibility is described in our Refund Policy. If a request has not started, contact help@mail.portcode.in as soon as possible. We may decline a refund where work has already been materially performed or where a request violates these Terms.

6. Intellectual property

You retain responsibility for materials you submit and must have the rights needed to submit them. PortCode retains its pre-existing tools, methods, templates, know-how, software, and general techniques. Unless a separate written agreement says otherwise, after payment you may use the specific deliverable created for your request for your lawful business or personal purposes, subject to third-party rights in the source material.

You may not represent a PortCode deliverable as an official product of the referenced website or use third-party content, trademarks, or assets without permission.

7. Third-party services

PortCode may rely on third-party services, including hosting, payment, email, storage, analytics, and infrastructure providers. Their services are governed by their own terms. We are not responsible for outages, decisions, or failures caused by a third party outside our reasonable control.

8. No warranties

PortCode is provided on an “as available” and “as is” basis. We do not promise that a reconstruction will be identical to a reference, error-free, uninterrupted, secure, compatible with every environment, or suitable for a particular purpose. You should test and review all deliverables before relying on them.

9. Limitation of liability

To the maximum extent permitted by law, PortCode and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the service. To the maximum extent permitted by law, our total liability for a request will not exceed the amount you paid for that request.

10. Indemnity

You agree to defend, indemnify, and hold harmless PortCode and its operators from claims, losses, liabilities, costs, and expenses arising from your submitted materials, your use of a deliverable, your violation of these Terms, or your violation of another person's rights.

11. Changes and termination

We may update these Terms or change, suspend, or discontinue any part of the service. The updated version will be posted on this page. We may refuse service or terminate access for violations of these Terms or for legitimate security, legal, or operational reasons.
